VISA Credit Card Agreement

In this Agreement and disclosure Statement, the words "you" and "your" mean each and all of those who agree to be bound by this agreement; "card" means the Varian SL Employees Credit Union’s credit card and any duplicates, renewals, or substitutions the Credit Union issues to you; "Account" means the VISA Credit Card Line of Credit account with us. We, us, and ours mean this Credit Union. "Credit Union" means the credit union whose name appears on this Agreement or anyone to whom the credit union transfers this agreement; and "Transaction" means use of the card or the account number on the card, and a personal identification number or "PIN" when required, to perform a transaction with this card.
  1. Responsibility. If we issue you a card, you agree to repay all debts and the FINANCE CHARGE arising from the use of the card and the card account. You are responsible for charges made by anyone else to whom you give the card, and this responsibility continues until the card is recovered. You cannot disclaim the responsibility by notifying us, but we will close the account for new transactions if you so request and return all cards. Your obligation to pay the account balance continues even though an agreement, divorce decree or other court judgment to which we are not a party may direct you or one of the other persons responsible to pay the account. Any person using the card is jointly responsible with you for charges he or she makes but if that person signs the card he or she becomes a part of this agreement and is also jointly responsible for all charges on the account, including yours.
  2. Member Liability. You agree to notify us immediately, orally at 801-973-5052 or 800-991-4964 (after hours) or in writing to 1678 So Pioneer Rd. Salt Lake City, Utah 84104 of the loss, theft, or unauthorized use of your credit card. You may be liable for the unauthorized use of your card. You will not be liable for unauthorized use that occurs after you notify us of the loss, theft, or possible unauthorized use. In any case your liability will not exceed $50 for unauthorized cash advances at ATMs. You will have no liability for unauthorized purchases made with your credit card.
  3. Card Ownership. The credit union reserves the right to cancel your card at any time. You may also cancel you Card at any time. The Card will remain the property of the credit union and you agree to surrender the card to the credit union at any time upon request. You further agree and understand that in the event the credit union elects to pick up and take possession of your card(s), you will pay the costs of that pick up, not to exceed the amount of $200.00.
  4. Credit Line. We will establish a line of credit for you and notify you of the amount. You agree to keep your account balance below this limit. You may request an increase in your credit line by written application to us that must be approved by our loan officer. We may also reduce your line of credit, revoke your card or terminate this agreement by written notice. This may be because you have failed to comply with this agreement, or our adverse re-evaluation of your credit worthiness. You may also close your line of credit. Cancellation by you or termination by us does not alter your responsibility to pay the balance due on your account. You must surrender to us all cards upon request and upon termination of this agreement. The credit union has a lien and right of set–off on all shares, deposits, and accumulated dividends or interest individual, joint, multiple party or transactions accounts for any amount due thereunder. The credit union may enforce its rights without notice or judicial process.
  5. Credit Information. You authorize us to investigate your credit standing when opening, renewing or reviewing your account. You authorize us to disclose information regarding your account to credit bureaus and other creditors who inquire.
  6. Monthly Payment. We will mail you a statement every month showing your previous balances or purchases and cash advances, the current transactions on your account, the remaining credit available. The new balances of purchases and cash advances. The total new balance, the FINANCE CHARGE due to date, and minimum payment required. Each month you must pay at least the minimum payment shown on your statement by the date specified. If your statement says the payment is "Now Due: your payment is due no later than 25 days from the statement closing date. You may pay more frequently, pay more than the minimum payment or pay the total balance in full. If you make extra payments, you are still required to make at least the minimum payment each month your account has a balance. The minimum payment is 3% of the total new balance, or $25.00 whichever is greater, plus the amount of any prior minimum payment(s) that you have not made, and any amount you are over your line of credit. The credit union also had the right to demand immediate payment of any amount by which you are over your credit limit.
  7. Finance Charge. A FINANCE CHARGE will be imposed on credit purchases only if you elect not to pay the entire new balance of purchases shown on your monthly statement for the previous billing cycle within 25 days from the closing date of that statement. If you elect not to pay the entire new balance of purchases shown on your statement for the previous billing cycle within the 25 days, a FINANCE CHARGE will be imposed on the unpaid average daily balance of such credit purchases from the previous statement closing date on new credit purchases from the date of posting to your account during the current billing cycle preceding the date on which the entire new balance of purchases is paid in full or until the date of payment if more than 25 days from the closing date. The FINANCE CHARGE will be imposed on cash advances from the date of the cash advance from the first day of the billing cycle in which the cash advance is posted to your account whichever is later and will otherwise be calculated in the same manner as explained above for credit purchases.
  8. Acceleration Costs and Fees. In the event any payment on your account is not made when due, or if an event of default occurs under any security agreement which may be executed in connection herewith, then the entire unpaid balance of all loan accounts under this agreement plus accrued interest shall become immediately due and payable at the option of the credit union. You also agree to pay the costs of collection and reasonable attorney’s fees and court costs.
  9. Charges and Fees. The current fees and charges applicable to this account are listed on the attached Schedule of Fees. Fees and charges may change from time to time. You may ask us to send you a current schedule at any time. The amount of any fees or charges will be deducted automatically from your Account.
  10. Plan Merchant Disputes. The credit union will not be responsible for the refusal of any merchant or financial institution to honor your card. We are subject to claims and defenses, other than tort claims, arising out of goods or services you purchase with the card, only if you have made a good faith attempt but have been unable to obtain satisfaction from the plan merchant and a.)your purchase was made in response to an advertisement we sent you, or b.) your purchase cost more than $50.00 was made from a merchant in your home state or within 100 miles of your current mailing address. Any other disputes you must resolve directly with the merchant. No dispute or claim by cardholder with respect to any goods or services by the use of the card shall reduce cardholder’s debt to the credit union except as provided by federal and state laws and the regulations thereunder relating to such disputes and claims, credit advice from seller to the credit union, and the credit union will credit such refunds to cardholder’s account.
  11. Foreign Transactions. Purchases, cash advances, and fees or charges made in foreign currency will be billed to you in US dollars. The conversion rate of dollars will be made in accordance with operating regulations for internal transactions established by VISA International, Inc.
  12. Returns and Adjustments. Merchants and others may apply credit for returns and adjustments. These will be posted to your account and if your credits and payments exceed what you owe us, we will hold and apply this credit balance against future purchases and cash advances. We will refund a credit balance upon your request.
  13. Using the Card. You may use the card and PIN to: withdraw cash from your account at ATMs, merchants, or financial institutions that accept VISA cards; transfer funds between your account and another account you have with the Credit Union; and make deposits to one of your accounts at the Credit Union. You may use the card without the PIN to: purchase goods or services at places that accept VISA cards; order goods or services by mail or telephone from places that accept Visa cards; and make automatic payments from your account to pay bills or other charges, providing that the person or organization that you are paying agrees to accept payments this way. Use of the card, the account number on the card, the PIN, or any combination of the three for payments, purchases, or to obtain cash from merchants, financial institutions, or others who honor VISA cards is an order by you to apply these transactions to your line of credit. Each transaction with the card will be charged to your account on the date the transaction is posted to your account. Use of the card is subject to the terms and conditions of your Account, and any future changes to your account may affect your use of the card.
  14. Effect of Agreement. This agreement is the contract that applies to all transactions on your account even thought the sales, cash advances, credit or other slips you sign or receive may contain different terms. We may amend this agreement from time to time by sending you a written notice as required by law. Your use of the card thereafter will indicated your agreement to these amendments. To the extent the law permits, amendments will apply to your existing account balance as well as to future transactions.
  15. Final Expression. This agreement is the final expression of the terms and conditions of the VISA line of credit between you and the credit unions; this written agreement may not be contradicted by evidence of any alleged oral agreement. Use of your VISA indicates that you will abide by all the terms and conditions disclosed in this agreement. Keep a copy of this agreement with your pin number in a safe place for future reference.
  16. Notices. All notices to the credit union must be given in writing and received at 1678 So. Pioneer Road, Salt Lake City, Utah 84104. Notices to cardholders shall be deemed reasonable and sufficient if mailed to the cardholder at the address on our files.
